Employment

Advance planning and attention to risk factors can prevent or reduce legal exposure in many employment situations.
Our in-depth experience with state and federal employment law statutes and employment-related disputes of nearly every category allows us to provide fast, efficient, and effective legal representation to our clients. Our practice emphasizes litigation prevention where possible, and assertive advocacy when litigation must be pursued. We represent individuals and businesses of all sizes.

Preventative advice and planning; agreements: We draft or review personnel policies and forms, provide advice on employment law compliance issues, conduct seminars for management personnel, and provide updates on legal developments. We also draft or advise clients regarding employment contracts, executive compensation, confidentiality and non-competition issues, and employee benefits/ERISA.

Assistance with urgent employment issues: Employers often need immediate help on issues such as a work force reduction, a workplace death or injury, a contemplated employee termination, or a sexual harassment claim. We provide prompt, thorough, and accurate advice, to help avoid or minimize legal claims and liability.

Dispute resolution: We represent clients in disputes before administrative agencies such as the Equal Employment Opportunity Commission, and in state and federal courts all the way up to the United States Supreme Court. We strive to be cost-effective, which requires knowledge of the applicable law, careful investigation, consideration of possible motions to obtain dismissal of claims, evaluation of the likelihood and range of an unfavorable outcome, and estimation of defense costs. We handle claims and issues related to: employment discrimination, wrongful discharge, Americans with Disabilities Act, Family and Medical Leave Act, wage/hour statutes, personnel policies, trade secrets and non-compete agreements, OSHA, COBRA, WARN (the plant closing law), and other employment law matters.
