Water Rights and Water Quality
Fairfield and Woods' attorneys have represented individuals, ditch companies, state and municipal governments, special districts, lenders and developers in water rights evaluation, acquisition, protection and transfer. We have handled cases in water courts involving applications for conditional and absolute water rights, changes of water rights, exchanges, plans for augmentation and determinations of abandonment. We assist clients in negotiating and effecting water transactions, and in obtaining well permits and other administrative matters before the Colorado State Engineer's Office. We also handle litigation related to water rights, such as disputes over ditch and reservoir easements, governance of ditch companies, and negotiation of ditch and well sharing agreements.
Our attorneys have represented clients in rule making proceedings before the Water Quality Control Commission, involving stream water quality standards and § 208 wastewater management. We have advised clients concerning requirements under § 404 for "dredge and fill" or wetlands permits. We have assisted clients in obtaining and appealing § 402 National Pollution Discharge Elimination System (NPDES) permits, and advised about compliance with effluent limitations and stormwater management requirements.
